Terms of Sale
These Terms of Sale apply to all quotations, orders and purchases made through Kozy Nest. By placing an order, the customer acknowledges that these Terms of Sale, together with the Shipping Policy, Refund & Return Policy and Warranty & Care Guide, form part of the agreement between the customer and Kozy Nest.
1. Australian Consumer Law
Nothing in these Terms excludes or limits any rights available under the Australian Consumer Law (ACL). Where required by the ACL, Kozy Nest will provide an appropriate remedy, including repair, replacement or refund.
2. Product Information
All products are handcrafted from genuine natural stone. Variations in colour, veining, texture and mineral composition are natural characteristics and are not manufacturing defects. Images are provided as a guide only.
3. Natural Stone
Natural stone may contain colour variation, veining, crystal formation, mineral deposits, filled areas, fossil markings and texture variation. These are inherent characteristics and are not grounds for cancellation, return or refund.
4. Dimensions & Tolerances
Unless otherwise specified, a manufacturing tolerance of up to ±5 mm is acceptable.
5. Quotations & Pricing
Quotations remain valid for 14 days unless otherwise stated. Prices may change after expiry.
6. Orders & Payment
Orders are confirmed upon receipt of the required deposit. Full payment must be received before dispatch or collection unless otherwise agreed in writing.
7. Custom Orders
Custom-made products and customer-approved stone slabs cannot be cancelled, amended or refunded once production has commenced.
8. Production
Lead times are estimates only and may change due to circumstances beyond Kozy Nest's reasonable control.
9. Delivery & Collection
Delivery and collection are governed by the Shipping Policy.
10. Risk & Title
Risk passes upon delivery or customer collection. Ownership transfers only after full payment has been received.
11. Inspection
Products should be inspected within 48 hours of delivery or collection. Claims must be submitted in accordance with the Refund & Return Policy.
12. Warranty
Warranty coverage is governed by the Warranty & Care Guide.
13. Returns
Returns are governed by the Refund & Return Policy.
14. Goodwill
Any goodwill assistance provided by Kozy Nest is entirely discretionary and does not constitute an admission of liability or create any precedent.
15. Force Majeure
Kozy Nest is not responsible for delays caused by events beyond its reasonable control.
16. Limitation of Liability
To the maximum extent permitted by law, Kozy Nest is not liable for indirect or consequential loss.
17. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
